The outcome of a lawsuit filed July 9 by the District of Columbia Attorney General charging Marriott International with misrepresenting facts connected to resort fees could impact all hotels and the event professionals who use them.

Resort, service, amenity, destination, and most recently, urban fees have become more common in recent years as mandatory charges not included in advertised room rates. They are often used to cover everything from internet access to access to the hotel’s health club. The United States Federal Trade Commission (FTC) warned hotels as early as 2012 that fees were not adequately disclosed on their reservation websites and might violate the law. In a 2017 report, FTC estimated that in 2015, consumers paid about $2 billion—35 percent more than in the previous year—and that number has only increased since then.

When asked for comment, Marriott representative Brendan McManus said, “We don’t comment on pending litigation, but we look forward to continuing our discussions with other state AGs.”

Smart Meetings talked to two hospitality professors to find out what the suit means for the meetings industry. Tyra Warner Hilliard, Esq, Ph.D., is an attorney and assistant professor at College of Coastal Georgia and a CMP and Sean Hennessey is a clinical assistant professor with Tisch Center of Hospitality.

Fee Trends

Since the 2008-2009 recession, hotels have followed the direction of airlines in “unbundling” services and charging separately for them rather than increasing prices for hotels and services as an inclusive purchase,” explained Warner Hilliard. “It gives hotels a way to increase prices by greater without seeming to,” she said.

Resort fees originally started as a way for resorts not to nickel and dime guests at every turn, Hennessey said. Fees have expanded to urban hotels, in some cases bundling items that once may have been provided gratis. “Although this is less of a problem today, many hotels originally did a poor job of making the fees and their value proposition clear to guests and getting buy-in,” he said. The lack of clarity has prompted some Attorney generals to look into these fees to constitute a deceptive advertising practice.

The key to this lawsuit is the fact that consumers cannot compare rates fairly because the fees are not disclosed until near the end of the transaction. That means that the consumer looking at rates for Marriott and three other hotel brands would see Marriott’s pre-resort fee rate and three other hotel rates that hypothetically are inclusive of all fees. “So, I’m comparing an orange to three apples. It’s not until I’m near the end of my booking that I realize the rate I thought I was getting isn’t complete,” she said.

This case is significant because it will set the standard for the level of transparency required by hotels in terms of their pricing and advertising structure, said Warner Hilliard. “When I have advised planners in the past, I have advised that they include language in their contract to this effect: ‘Neither the group nor its attendees will be responsible for any fees or surcharges not enumerated in this contract or agreed upon in writing at check-in,’ ” she said. This lawsuit addresses the issue on a larger scale, requiring hotels to disclose fees in the reservation process for transient travelers just as they do for group guests.

Warner Hilliard predicted that the point of the lawsuit is not just to change practices at the world’s largest hotel brand—and its franchise owners who actually charge and keep the profits from the fees. “I think the goal of the lawsuit is to get all hotels, not just those involved in the lawsuit, to change business practices,” she said.

Warner Hilliard compared a potential multimillion-dollar fine or settlement to the nudge the Americans with Disabilities Act provided in the 1990s. “It makes a great boogeyman,” she said. Everyone scrambled when the first lawsuits were filed to make sure they were compliant out of fear of being in violation of this law. The same thing happened recently with GDPR. “I don’t like that we have to scare people into doing the right thing, but sometimes I feel like that’s what lawsuits are about,” she said.

In the meantime planners can continue to try to negotiate to eliminate some or all of the fees, depending on whether they are collected for things at a hotel with a real, ongoing cost or for maintenance and upgrades. “As is true with anything in terms of negotiation, it never hurts to ask,” said Warner Hilliard. The worst that can happen is you hear “no.”

Think virtual reality (VR) goggles are only useful for your teenage nephew’s video games? Think again. Smart Meetings got a behind the scenes look at the emerging technology from Sandy Hammer, Co-Founder of AllSeated. This collaboration network for planning events uses stereoscopic display to create realistic VR tools for venues and planners. Here is what we learned:

The Vision

Girl, Stop Apologizing, by Rachel Hollis

If you haven’t read Hollis’ first book, Girl, Wash Your Face, then, well, read it. Full of actionable ideas, Hollis gives blunt advice in a captivating way on how women can (and should) shed their fears and aim to reach their full potential. Armed with the idea that women often talk themselves out of achieving their dreams, Hollis, rather unapologetically, teaches women (and men) everywhere to let go of the excuses holding them back from greatness. Let’s be honest—who wouldn’t benefit from this book?

Tools of Titans, by Tim Ferris

Published in 2016, this title isn’t exactly new, but it is, in our opinion, one of the best self-help books ever written. If you do not own a copy, we suggest you remedy that immediately. Tim Ferris’ book combines a large collection of advice on “The Tactics, Routines and Habits of Billionaires, Icons and World-Class Performers,” the subtitle of the book.

The idea behind it is simple: No one can be an expert on everything, but a lot of people can be experts on very specific things, so, why not bring all that expert advice into one place? The format is easily digestible, and the advice consists of real things that “normal” people can actually do. Split into three sections—healthy, wealthy and wise—the book covers a wide range of topics, so there is something in it for everyone—especially planners!

Poetry

Little Boy, by Lawrence Ferlinghetti

Lawrence Ferlinghetti’s new book came out in 2019 to celebrate the poets 100th birthday (yes, you read that right, the man wrote and published a book at 100 years old). The first poet laureate of San Francisco and co-owner of renowned publishing house and bookstore City Lights, Ferlinghetti holds a special place in San Francisco literary history. He was a founding force in the beat movement in the ’50s and his poetry reflects that style.

This memoir-cum-poetry book touches on Ferlinghetti’s life, memories and ideas about the ever-shifting social fabric he grew old in. Robert Pinsky’s review in The New York Times Book Review perhaps best encapsulates the over-arching question of the book: “Who, little boys and girls, juvenile yet old, do we think we are?”

With recent news of Custom and Border Protection’s (CBP) Global Entry program being ‘vulnerable to exploitation,’ we have zoomed in on the issue and explored the use of the Global Entry program for meeting professionals and attendees. Global Entry is a United States CBP program that allows expedited clearance for pre-approved, low-risk travelers upon arrival in the United States and other countries. We reached out to Global DMC Partners President Catherine Chaulet to talk about Global Entry for international travelers.

Chaulet says that global meetings are a must for companies with global footprints and international travel is a great way to incentivize employees (especially millennials). With the point of international travel being to explore and experience a new destination and culture, people want to spend as little time as possible in the process of getting there. This is where Global Entry comes in: Think of how many croissants you can eat with an extra hour or two in Paris because you skipped the customs line!

While not all clients are yet a part of the Global Entry program, Chaulet states that some are and, “the more international the footprint, the more we see corporations promoting [Global Entry] internally.” The significance of skipping customs lines through Global Entry programs extends not only to saving time and arriving at destinations more quickly, but also to lowering stress and simplifying the overall travel experience.

The current significance of Global Entry in the news involves a report made by the Inspector General in June, stating that the “Global Entry Program [does] not always prevent ineligible and potentially high-risk Global Entry members from obtaining expedited entry into the United States.” This report was acknowledged and responded to by U.S. CBP, who are working with U.S. Homeland Security to ensure the program remains secure and efficient. While this audit should not affect so-called low-risk travelers, it speaks to the integrity of the program and reminds us of the usefulness of Global Entry for planners and attendees who wish to spend more time at meetings or exploring new cities and less time in a customs queue.

Society of Government Meeting Professionals (SGMP)

The 38th National Education Conference (NEC) will be held in St. Louis, Missouri next year. From May 19–21, 2020 the Cervantes Convention Center at America’s Center in St. Louis will be overrun with government and contract planners and suppliers. Marriott St. Louis Grand has been named the convention hotel. It lies in the center of the city, a short walk from the convention center and many popular attractions including the City Museum, Gateway Arch and Busch Stadium where you can catch a Cardinals game.

American Society of Association Executives (ASAE)

Attendees of ASAE’s Annual Meeting and Exposition will hit The Strip next year as they travel to Las Vegas for one of the industry’s biggest events. From Aug. 8–11, 2020, thousands of association professionals will stay at Mandalay Bay Resort and Casino where the event will be hosted. In between meetings, visitors can take a helicopter tour of the strip, go to a show or splurge on a shopping spree. When the conference action gets too hot, beat the desert heat at Mandalay Bay Beach. 

Professional Convention Management Association (PCMA)

PCMA is headed to the golden coast in 2020. PCMA Convening Leaders 2020 runs Jan. 5–8 in San Francisco. Featured speakers include Bozoma Saint John, David Meade and Heather E. McGowan. Stay in the classic Westin St. Francis or mix things up at Hotel Zelos San Francisco or Yotel San Francisco. From hiking in the Marin Headlands to wine tasting in Napa or simply a walk across the Golden Gate Bridge, the city by the bay has something for everyone. Just make sure to bring a coat. Karl the fog is notorious for hanging out in San Francisco for days on end.

Society for Incentive Travel Excellence (SITE)

Want an excuse to visit one of Canada’s best cities? Then head to Vancouver Jan. 24–27 for the MICE industry’s 2020 Global Conference. The event hosts incentive travel professionals from all around the world who lead and participate in educational sessions, certification opportunities, evening events, celebrations, award ceremonies, and tours. Spend a few days getting to know one of North America’s friendliest cities and enjoy everything that British Colombia has to offer from hiking to wine country to beer bikes and even a revolving restaurant at the top of the Harbour Center Tower.

Meeting Professional International (MPI)

MPI’s World Education Congress (WEC) moves to Grapevine, Texas, in 2020. From June 6–9, this emerging destination a half hour from Dallas will deliver the genuine hospitality of the Lone Star state. Hilton DFW Lakes is set in 40 acres of wooded area on Grapevine Lake. It boasts tennis courts, pools and hiking trails through the woods for an authentic feel of the Texan landscape.

MPI’s annual European Meetings and Events Conference (EMEC) goes to Seville, Spain Feb. 9–11. Get a room at Barcelo Sevilla Renacimiento and take your siesta in one of their 295 rooms or on a chaise by the pool after a morning of meetings. Financial and Insurance Conference Professionals (FICP)

FICP Annual Conference 2020 will be held in the nation’s capital next year. From Nov. 15–18, Washington Hilton will host its annual conference in downtown Washington, D.C. The conference is ‘known for its array of educational opportunities and dedicated networking time’ as it brings together meeting professionals to explore, innovate and connect. Located next to the multicultural and lively Adams Morgan neighborhood, attendees can explore countless eclectic restaurants offering everything from Ethiopian to Vietnamese cuisine. In addition to all the well-known attractions of the capitol, attendees can stray off the beaten-path and pop into DC Art Center, a gallery and performance space for upcoming artists. 

International Association of Conference Centers (IACC)

Just 30 minutes from Dallas lies the newly opened Delta Hotels Dallas Allen & Watters Creek Convention Center. The venue is an expert in meeting the needs of the traveler. It is here that IACC Americas Connect 2020 will be held, from March 30–April 1, 2020. While the convention center has all the amenities guests could need to relax and wind down after their meetings, the local areas of Watters Creek and Allen offer experiences of a traditional Texan town. For sports fans, the Allen Americans Hockey team and Dallas Sidekicks soccer team play just a few miles from the convention center and a brewery lies less than a mile from the hotel, so you can grab a beer on the way to the game. 

International Congress and Convention Association (ICCA)

The 59th ICCA congress opens Nov. 1, 2020, in Kaohsiung, Chinese Taipei in the towering 85 Sky Tower Hotel. The hotel is part of a landmark from which guests have spectacular views of the city. The Garden Villa and Urban Hotel33 are a few of the other wonderful accommodation options in the city.

Last week, thousands of companies and professionals gathered in New York to showcase, taste and judge the best specialty foods in the United States. Specialty food, an important and fast-growing sector of the food industry takes center stage at The Summer Fancy Food Show. The show is the largest specialty food industry event in North America, hosted by Specialty Food Association. This year’s show was held last month and, according to the host, was “The place to see and taste the future of food.”

With various awards ceremonies, product showcases, competitions and speakers, the event rounded-up all the specialty food trends of 2019. Here are the take-aways from the show floor that will keep your F&B on-trend, sophisticated and delicious.

  • Go beyond meat and animal produce. While a shift away from meat is nothing new, 2019 Business Leadership Award Winner Miyoko Schinner proves that a shift away from animal products is on the horizon. Schinner’s brand, Miyoko’s, is an example of how plant-based cheeses and butters are becoming more and more mainstream and the ‘tomorrow’ alluded to in her slogan, ‘tomorrow’s creamery’ is just around the corner.
  • Several companies have joined the mission to save ugly produce from becoming waste. These chips are made with ‘ugly’ potatoes or one’s that fail to meet the USDA’s cosmetic standards. San Francisco based Imperfect Produce is another example of an attempt to save ‘ugly’ (yet perfectly safe and delicious) produce by delivering boxes of it to customers at reduced prices.
  • As current food trends lean toward healthier options, we see an increase in alternatives to alcohol. This includes non-alcoholic spirits and drinks such as kombucha and non-alcoholic beer. Leading the charge in non-alcoholic spirits is Seedlip, a company set out to change the way the world drinks and introduce bespoke non-alcoholic drinking options. Just like Seedlip, kombucha producers across the globe are offering alcohol-free, healthy, interesting beverages. Kombucha sales are expected to rival craft beer sales in coming years.
  • Continuing with the health-conscious trend, consumers are looking to buy shelf-stable fresh food and probiotics. The huge probiotic movement that started a few years ago with kimchi and kombucha is alive and well, just like the bacteria going into new, shelf-stable products. Nutrition bars, granola, nut butters and other snacks are getting even healthier as several companies are adding probiotics to them to keep your gut—and hopefully your attendees—happy.
  • Superfoods have been touted as life-altering and earth-shattering products that will turn anyone into the health guru of their dreams. While that might be over the top, the extreme nutrient density of superfoods can be highly beneficial. The Specialty Food Association awarded Lisa Kurtis of Kuli Kuli the Citizenship Leadership Award 2019. Kuli Kuli makes moringa, a super leafy green, available in smoothie mixes, power bars, teas, shots and powder form. Kurtis says taking moringa powder every morning has helped return her energy and vigor; and it’s caffeine free. While superfoods might not change everyone’s life, I am sure attendees will welcome a little energy boost in their morning smoothie or mid-afternoon power bar.
  • The sofi Awards recognize the best and most innovative products from 37 categories. This year, Specialty Food Association found four flavor and ingredient trends among the 100+ products recognized in the 2019 sofi Awards. These flavors include: rosemary, lavender, pink peppercorns and bourbon and rye. These ingredients were found in everything from rosemary root vegetable chips to lavender hemp chocolate bars, pink peppercorn sodas and bourbon washed cheeses, but the opportunities to incorporate these flavors into your menu are truly endless.
